Sharing your living space with a roommate can have several social and financial advantages. However, conflicts can arise, and it is recommended that you draft a roommate agreement in advance to make sure everyone agrees on certain terms and all expectations, obligations and duties are clear from the start. You will not be able to take your roommate to court for breach of this agreement, but it can be very useful if you seek mediation to resolve disagreements.

You should list all your requirements and expectations before you begin drafting the agreement. However, it is important that you leave room for changes and are willing to be flexible, if you actually want to get a roommate who agrees to your terms.

Roommate Agreement Contract Template

This agreement is being entered into by (name of roommate 1) and (name of roommate 2) on this day (date) of (month and year) in order to clarify the rights, duties and obligations of both parties related to living in the house located at (complete address).

  1. Rooms: It is agreed that (name of roommate 1) will be using the bedroom to the left of the entrance and (name of roommate 2) will be using the one on the right. Both parties are entitled to complete enjoyment of their rooms, washrooms and attached fixtures.
  2. Common hall: The living room is to serve as the common hall, where either party can spend time and arrange activities which do not infringe on the other’s rights.
  3. Guests: Both parties are allowed to invite guests to the house, but notice of the same must be given to the other party at least one day in advance. The roommate inviting the guests will be liable for any damage to property or personal injury related to the guests.
  4. Utility bills: Bills for utilities, such as electricity and water, shall be shared equally by both roommates unless one of them is evidently using considerably more resources than the other. In that case, the share of payments shall be reasonably decided by mutual discussion.
  5. Telephone and internet: Internet bandwidth will be equally distributed between both roommates and both will be responsible for recording the details of the calls they make using the landline.
  6. Termination of agreement: In case either party wishes to terminate the agreement, he/she will have to inform the other roommate at least one month in advance.
  7. Rent payments: Both roommates will be individually liable for rent payments to the landlord and will not be responsible for the other’s dues.
